Specifically, the user accepts and warrants that by using the app and services, their actions do not violate the laws, rules or regulations of (1) country, state or locality in which they reside, or (2) country, state or location. where Makeup Upon Arrival is located or operating.
Ability to Accept:
You represent and guarantee that you are of legal age and otherwise

entering into this Agreement on behalf of an entity, that you are

Property:
The Services and all related rights are, and will remain our property. Neither these Terms nor the use of the Services grant or grant the user any right in relation to the Services, except for the limited license granted previously, or to use or refer in any way to the names of the companies, logos, to the Names of products and services, brands or services. All content that appears on the Makeup Upon Arrival platform are owned by us, and our partners and is protected by international copyright laws. Some names, graphics, and logos are trademarks, service marks or commercial image (collectively, “Trademarks”) of Makeup Upon Arrival . Our trademarks may not be used for any purpose, except under our trademark use policy. All other trademarks are the property of their respective owners and may not be used without prior written consent.
If you print, copy, modify, download or otherwise use or provide third parties with access to any part of the app that violates the Terms of Use, your right to use the app will cease immediately and, at our discretion, return or destroy any copy of the materials you have made. No right, title or interest in or on the app or any content on the app is transferred to the user and Makeup Upon Arrival reserves all rights not expressly granted.

You acknowledge that by offering the user the ability to view and distribute the users generated in the Service, we simply act as a passive channel for such distribution and assume no obligation or liability in relation to any content or activity in the Service.
Requesting an appointment for Our Services:
To request an appointment for any of our Services, you may be asked to specify the type of service that you think is required, the location where you would like the service requested for to be performed, and the date and time that you would want it to take place. You agree that it is your responsibility to provide a suitable location and to ensure that the Specialist has proper access and permission, and is legally authorized to complete your request at the location.
Once you submit a request, we may provide you with a price and/or a list of available Specialists along with their experience information and “rating” based on previous customer reviews (if applicable). Once an order is accepted the Specialist has two hours and thirty minutes to arrive at the customers location. We reserve the right to process payment via otp, modify, add, and deduct items or price at any time prior to billing you. Confirmation of the service request otp means you are satisfed with the services rendered, and you have agreed with the final invoice after added or deducted items and fees.
You agree to treat the Makeup Upon Arrival Specialist courteously and lawfully, to provide a safe and appropriate working environment that is in compliance with all applicable laws and regulations, and to provide reasonable cooperation to enable Specialist to complete their Job. We do not control the availability of the independent Specialist on the Makeup Upon Arrival Platform. You acknowledge that your selected Specialist may be unavailable from time to time, due to illness, scheduling or vacation. Please note that there must be no unsupervised pets , kids , smoke, nudity, pornographic material, weapons, drugs or paraphernalia in the general working vicinity. Work must be done in a common area for example, living room, dining room with functioning outlets in reach. Specialist must feel comfortable at all times. Any threats, physical harm or sexual advances are NOT ALLOWED! And could be legally prosecuted and banned from Makeup Upon Arrival.
Purchase:
If you wish to purchase product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number and the expiration date of your credit card.
You present and warrant that: (i) you have the legal right to use any credit card(s) or other payment methods (s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.
By submitting such information you grant us the right to provide the information to third parties for the purpose of facilitating the completion of Purchases.
We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to product or service availability, errors in the description of the price of the product or service, error in your order or other reasons. We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.
Payment Terms:
You understand that use of the Services may result in charges to you for the Services you receive from a Specialist (“Charges”). Charges may include any applicable federal, state and local taxes. At the time you schedule an appointment, we will record your preferred payment method information and validate your payment information. You authorize the payment of Charge(s) according to your preferred payment method information, or, if applicable, the payment of a cancellation fee if you cancel a request/appointment. You agree not to make any alternative payment arrangement with the specialist who performs the Job. While we will use commercially reasonable efforts to ensure the security of all credit card and all other personal information, we expressly disclaim any liability for any damage that may result should any information be released to any third parties, and you agree to hold us harmless for any damages that may result therefrom.
After you have received Services obtained through your use of the Service, we will facilitate your payment of the applicable Charges on behalf of the Specialist, as such Specialist limited payment collection agent. Payment of the Charges in such manner shall be considered the same as a payment made directly by you to the Specialist. Charges paid by you are final and non-refundable unless otherwise determined by us. All Charges are due immediately.
If your primary payment method is determined to be expired, invalid or otherwise not able to be charged, you agree that we may, as the Specialist limited payment collection agent, use a secondary payment method in your Account, if available.
Taxes:
You are responsible for determining any and all taxes assessed, incurred, or required to be collected, paid, or withheld for any reason for your use of the Payment Services (“Taxes”). You also are solely responsible for collecting, withholding, reporting, and remitting correct Taxes to the appropriate tax authority. We are not obligated to, nor will we determine whether Taxes apply, or calculate, collect, report, or remit any Taxes to any tax authority arising from any transaction.
Cancelation of Service Request By You or By Artist:
You may cancel a scheduled appointment at any time, subject to the following. Service appointments booked on any day other than the current day are required to be cancelled 24 hours before the scheduled start time to avoid a cancellation fee e.g., an appointment booked for Friday 6pm should be cancelled no later than Thursday 6pm. If you cancel within 24 hours of the scheduled start time you will be charged a (25 percent) cancellation fee. Any and all bookings cancelled within the first twenty minutes of booking will not incure a cancellation fee. We reserve the right to establish, remove and/or revise our cancellation policy or cancellation fees at any time at our discretion.
When a Specialist cancels a scheduled service, we generally notify you and give you the option to reschedule. However, we cannot guarantee that a cancelled appointment will be accepted by another Specialist, rescheduled, and/or completed. Specialists reserve the right to refuse a request.
You hereby agree to hold us harmless from any liability that may result from the cancellation of an appointment or service request or refusal of a Specialist to complete the service.
There may be instances where, after a Specialist has arrived at your location, the artist finds that he or she is not able to successfully complete the Job/service request, for reasons including, without limitation, that the Specialist does not have access or permission to work at the location you provided, that the location is not fit for services, or that the information you provided with respect to your address is inaccurate or incomplete. In such instances, you may be charged a minimum fee or cancellation fee. Intellectual Property Rights and Grant of Rights to Use The features, information, and materials provided and depicted through the Services are protected by copyright, trademark, patent, and other intellectual property laws. All text, graphical content, video, data, and other content made available through the Services (collectively, the “Makeup Upon Arrival Content”) are provided to User by Makeup Upon Arrival solely to support User’s permitted use of the Services. The Makeup Upon Arrival Content may be modified from time to time by Makeup Upon Arrival in its sole discretion. Except as expressly set forth herein, no license is granted to User for any other purpose, and any other use of the Services or the Makeup Upon Arrival Content by User shall constitute a material breach of this Agreement.
Makeup Upon Arrival retains all rights in the Services and Makeup Upon Arrival Content and any associated patents, trademarks, copyrights, mask work rights, trade secrets, or other intellectual property rights. No license, right, or interest in any trademarks of Makeup Upon Arrival or any third party is granted under this Agreement.
Application License:
Subject to the terms and conditions of this Agreement, Makeup Upon Arrival grants User a non-exclusive, non-transferable, revocable license to use the Makeup Upon Arrival Application, in object code form only, on User’s compatible mobile devices, solely to support User’s permitted use of the Services.
Ads:
Makeup Upon Arrival and its licensors may display advertising and other information adjacent to or included in the Content. You have no right to any payment for these publications. The method and scope of such advertising are subject to change without notice.
Third-Party Links:
The app provides links to other sites or resources. Confirm and accept that we are not responsible for the availability of such external sites or resources and that we do not approve or are responsible, directly or indirectly, for the privacy practices or content (including non-representative or defamatory content) of such apps, including (a) advertising, products or other materials or services on or available from such sites or resources, or for any damage, loss or crime caused or allegedly caused by, or in connection with, the use or dependence of such content, goods or services available on such apps or external resources. The use of links to other apps and resources is at your own risk and it is the responsibility of the user to verify and comply with the terms and conditions of all linked apps visited.
You should thoroughly review your privacy policies or statements on any other app you visit, as these privacy policies or policies will apply to your visit to that app and may vary significantly from our privacy policy.
Communications:
The Makeup Upon Arrival Application may use GPS locator capabilities to identify your current location. If you provide a mobile phone number, you hereby expressly consent to receive SMS text messages from Makeup Upon Arrival regarding the Services and as otherwise described in our privacy policy.
The communication standards for the Services include but are not limited to SMS, GPS, and web-based browser technology. In order to use the SMS-based Services, you must maintain an active account with a carrier of electronic communications through mobile devices and you may not use a prepaid cellular phone to access the Services.
Technical Requirements:
Use of the Services requires Internet access through your computer or mobile device. You are responsible for all mobile carrier charges resulting from your use of the Services, including from any notifications provided by the Services.
Makeup Upon Arrival does not guarantee that the Services will be compatible with all devices or will be supported by all mobile carriers. Modifications to Services
Makeup Upon Arrival reserves the right, in its sole discretion, to modify the Services from time to time and without notice, including, without limitation, by removing, adding, or modifying portions of the Makeup Upon Arrival Application.
Makeup Upon Arrival shall have no liability to you for any of the foregoing actions. If you object to any such changes, your sole recourse shall be to cease using the Services. Continued use of the Services following any such changes shall indicate your acknowledgment of such changes and satisfaction with all the Services.
User Restrictions:
The Services and Makeup Upon Arrival Content are offered solely for the User’s personal use for the purposes described in this Agreement. Any and all other uses are prohibited. Makeup Upon Arrival expressly reserves all its rights and remedies under applicable state and federal laws. Makeup Upon Arrival reserves the right, in its sole discretion, to refuse service, terminate accounts, remove or edit content, cancel reservations, or deny access to the Services. You agree not to (and not to
allow any third party to): (1) use any robot, spider, scraper, or other automatic or manual device, process, or means to access the Services or copy any Makeup Upon Arrival Content, except as expressly authorized by Makeup Upon Arrival ; (2) take any action that imposes or may impose (in Makeup Upon Arrival ’s sole determination) an unreasonable or a disproportionately large load on the Services or Makeup Upon Arrival ’s infrastructure; (3) utilize any device, software, or routine that will interfere or attempt to interfere with the functionality of the Services; (4) rent, lease, copy, provide access to or sublicense any portion of the Services or Makeup Upon Arrival Content to a third party; (5) use any portion of the Services or Makeup Upon Arrival Content to provide, or incorporate any portion of the Services or Makeup Upon Arrival Content into, any product or service provided to a third
party; (6) reverse engineer, decompile, disassemble, or otherwise seek to obtain the source code or non-public APIs to the Services, except to the extent expressly permitted by applicable law (and then only upon advance notice to Makeup Upon Arrival ); (7) modify any Services or Makeup Upon Arrival or create any derivative product from any of the foregoing; (8) remove or obscure any proprietary or other notices contained in the Services or Makeup Upon Arrival ; (9) use the Services or Makeup Upon Arrival Content for any illegal purpose; or (10) publicly disseminate information regarding the performance of the Services or Makeup Upon Arrival or access or use the Services or Makeup Upon Arrival for competitive analysis or benchmarking purposes.
Termination:
Makeup Upon Arrival may suspend your ability to use all or any element of the Services or may terminate this Agreement effective immediately, without notice or explanation. Without limiting the foregoing, Makeup Upon Arrival may suspend your access to the Services if we believe you to be in violation of any part of this Agreement (including any Makeup Upon Arrival Policies). After any suspension or termination, you may or may not be granted permission to use the Services or re-establish an Account.
You agree that Makeup Upon Arrival shall not be liable to you for any
termination of this Agreement or for any effects of any termination of
this Agreement. You are always free to discontinue your use of the Services at any time. You understand that any termination of your Account may involve deletion of any content stored in your Account for which Makeup Upon Arrival will have no liability whatsoever.
You may not use a false email address, licenses, impersonate any person or entity, or otherwise mislead as to the origin of User Content. Makeup Upon Arrival reserves the right (but has no obligation) to monitor, remove or edit User Content in Makeup Upon Arrival sole discretion, including if User Content violates this Agreement (including any Makeup Upon Arrival Policies), but you acknowledge that Makeup Upon Arrival may not regularly review submitted User Content. If you do submit User Content, and unless we indicate otherwise, you grant Makeup Upon Arrival a nonexclusive, perpetual, royalty-free, irrevocable, and fully sub-licensable (through multiple tiers) right to use, modify, reproduce, adapt, translate, publish, create derivative works from, distribute, display, and otherwise exploit such User Content throughout the world in any media. Makeup Upon Arrival takes no responsibility and assumes no liability for any User Content submitted by you or any other User or third party.
You may terminate this Agreement by completely and permanently ceasing to use the Services (provided that there are no outstanding Services ordered under your Account). If you attempt to terminate this Agreement while there are still outstanding Services ordered under your Account, this Agreement shall not terminate until such Services have been performed or otherwise canceled as permitted by this Agreement.
Representations and Indemnity:
You represent and warrant that you own or otherwise control all of the rights to any User Content submitted by you; that all User Content submitted by you is accurate; and that exploitation of such User Content by Makeup Upon Arrival and its other Users, partners, and licensees will not violate this Agreement, cause injury to any person or entity, or infringe any third-party rights (including, without limitation, intellectual property rights and rights of privacy or publicity). You will indemnify, hold harmless, and (at Makeup Upon Arrival request) defend Makeup Upon Arrival , their representatives, agents, directors, managers, officers, employees, and shareholders (collectively, the “Makeup Upon Arrival Parties”) from and against all claims resulting from (1) any User Content submitted by you, (2) your use of the Services, or (3) any breach or alleged breach by you of this Agreement.
Vetting of Third Party Providers:
Makeup Upon Arrival Specialists may be subject to an extensive vetting process before they can register and during their use of the Makeup Upon Arrival Platform, including a comprehensive criminal background check.
Although we may perform background checks of Artists, we cannot confirm that each Artist is who they claim to be and therefore, we cannot and do not assume any responsibility for the accuracy or reliability of identity or background check information or any information provided through the Makeup Upon Arrival Platform. When interacting with Artists, you should exercise caution and common sense to protect your personal safety and property, just as you would when interacting with other persons whom you don’t know.
WE ARE NOT RESPONSIBLE FOR THE CONDUCT, WHETHER ONLINE OR OFFLINE, OF ANY USER OF THE Makeup Upon Arrival PLATFORM AND YOU HEREBY RELEASE US FROM ANY LIABILITY RELATED THERETO. WE WILL NOT BE LIABLE FOR ANY CLAIM, INJURY OR DAMAGE ARISING IN CONNECTION WITH YOUR USE OF THE Makeup Upon Arrival PLATFORM.
In home service Terms:
Client must have fully functional working electrical outlets. Our Specialist are experts who execute high quality services steady and efficiently. We kindly ask that they’re no unsupervised children under 16 in the general work area. Pets must be placed out of sight it is recommended pets are relocated “Securely” outside, in another location, room, or cage. Service dogs are allowed please let us know of service animals before booking appointment.
Client and or Specialist may not bribe, or exchange contact info to schedule appointments outside of “Makeup Upon Arrival” platform. If this happens, the
Specialist and Client account will be closed. If a client is unsatisfied with work after completion, send us an email mua@makeupuponarrival.com with pictures within 24 hours.
We will make sure to reschedule but if there is no specialist available, we will
consider refund based on our discernment after viewing pictures sent. If you have been diagnosed with COVID 19 or you think you have COVID 19, please let us know before booking at muallcapp@gmail.com or click the cancel button.
Liability Limitations:
In no event shall the Makeup Upon Arrival Entities be liable for any indirect, incidental, special, exemplary, reliance, health-related problems, consequential or punitive damages, including without limitation, loss of profits, business interruption, reputational harm, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
Disclaimer of Warranties:
Your use of the Service is at your own discretion and sole risk. The Service is provided on an “AS IS”, “WITH ALL FAULTS” and “AS AVAILABLE” basis, with the express understanding that the Makeup Upon Arrival Entities may not monitor, control, or vet user content.
